On March 30, 2021, amendments No. 1357-IX to the Law of Ukraine “On Military Duty and Military Service” came into force.
In particular, Part Eleven of Article 1 as amended by the Law stipulates that: “women who have a speciality and/or profession related to the relevant military accounting speciality defined in the list approved by the Ministry of Defence of Ukraine, and are suitable for military service for health and age, shall be taken on the military register of those liable for military service”.
The purpose of adopting amendments to the Law is to improve the organizational and legal basis for recruiting the Armed Forces of Ukraine and other military formations with highly professional personnel both in peacetime and in a special period, which will increase the number of highly qualified, trained in the relevant specialities of those liable for military service. Also, the system of military registration and activities of local military administration bodies will be brought into line with NATO standards.
On December 17, 2021, Order of the Ministry of Defence No. 133 of October 11, 2021 entered into force (published in the Official Gazette of Ukraine No. 96 dated December 17, 2021). It approved the “List of specialities and/or professions related to the relevant military accounting specialities, after obtaining which women liable for military service are registered for military service”.
According to Article 28 of the Law on Military Duty, the maximum age in reserve is up to 60 years.
The List includes 35 types of specialities (each of which is, in fact, a separate branch of economic activity), the List includes all the most popular areas – from public catering to publishing and printing. This List also includes hundreds of professions.
Due to this, both the management of enterprises in these industries, as well as employees of working professions and specialists should be registered in the military. In other words, the administration (the director, the head of the department, a lawyer, a secretary, etc.), and the employee herself who has a certain speciality and works in a certain industry will be registered.
For example, there are the following professions in this list:
- heads of financial, accounting, economic, legal and administrative divisions and other managers,
- managers in law, accounting, market research, public opinion research, commercial and management consulting,
- accounting managers,
- audit and accounting professionals,
- research staff (audit, accounting), others
Military registration is not a call-up. These legislative changes will not affect the lives of Ukrainian women now, and by the end of 2022, it may be necessary to register with the territorial recruitment and social support center at the place of residence. During 2022, we should not expect any problems. In the future, fines are provided for evading military registration, as well as for men, after a warning from territorial recruitment and social support centers.
Employers should control this; fines range from UAH 5,100 to UAH 8,500.
Women who are registered in the military can be called up for military service or attracted to perform work to ensure the defence of the state in wartime. In peacetime, women can only be called up for military service and service in the military reserve on a voluntary basis (under a contract).
All women aged 18 to 60 years who have a speciality and/or profession related to the relevant military accounting speciality defined in the list approved by the Ministry of Defence of Ukraine and are suitable for military service for health and age reasons are subject to military registration.
You need to register for military service by the end of 2022 at the territorial recruitment and social support center (former commissariat) at the place of registration of your place of residence.
The military accounting speciality is determined not only by the diploma, but also by an entry in the employment record book – the work experience and KVEDs of an individual entrepreneur. Finally, belonging to the military accounting speciality is determined in the territorial recruitment center.
When changing your profession, you will need to inform the territorial recruitment and social support center, which will allow you to better track the available human resources.
Pregnant women and/or young children are also registered in the military. As in the case of men, the territorial recruitment center and joint venture for women will take into account the state of health of the person and his family circumstances.
Work on the implementation of the order is planned until the end of 2022. The goal is to bring the country to the current legislation and know its reserves.
By the end of 2022, the General Staff of the Armed Forces of Ukraine will analyse changes in the number of women liable for military service who are registered in the military.
